Overview

Stephanie W. Holtz is an associate whose practice is focused on Special Education and Student issues affecting public school districts and clients. Ms. Holtz also supports school districts and county offices of education in navigating various governance matters including board policies and regulations, and Public Records Acts requests.

Experience

Ms. Holtz has represented school districts in a variety of special education matters including IEP meetings, mediation, resolution sessions, and due process hearings. Ms. Holtz has drafted and reviewed school district master contracts, board policies and regulations, and operating agreements, including analyzing and evaluating special education related cases, conducting legal research, drafting motions, briefs, and memoranda, and reviewing and drafting settlement agreements. Ms. Holtz has also presented on a variety of special education topics at Lozano Smith’s annual Special Education Legal Consortium as well as at workshops and retreats for various school districts.

Ms. Holtz works with local education agencies to review and update board policies and administrative regulations on a variety of topics, including Title IX policy matters. Ms. Holtz is also experienced in reviewing, drafting language, and advising on public entities’ contracts with third-party agencies, procuring student, special education, and related services. Ms. Holtz also assists agencies with Office of Civil Rights complaint response, Uniform Complaint response, and drafts responses to the California Department of Education on behalf of local education agencies.

Recently, Ms. Holtz has represented school districts in litigation matters involving student expulsions before the California State Appellate Court which included researching and drafting demurrers, responses to writ of mandates, and appellate briefs.

Prior to joining Lozano Smith, Ms. Holtz practiced family law for 10 years conducting legal research, case analysis, drafting and responding to written discovery, and appearing in court on behalf of clients in multiple counties throughout Northern California.

Education

Ms. Holtz earned her Juris Doctor from McGeorge School of Law. While in law school, Ms. Holtz gained hands on experience working as a special education instructional aide in RSP and moderate/severe special day classes for students with autism. She also interned with Sacramento Child Advocates educational division which supported the educational needs of students in dependency court as well as the Juvenile Public Defenders Office where she represented minors at arraignment and plea hearings. She earned her Bachelor of Arts in Criminal Justice from San Francisco State University.
