from a party or participant to a proceeding, or his or her agent, while the proceeding
is pending and for three months after. And an officer of an agency may not
participate in such a proceeding if the officer has received a contribution of more than
$250 from a party, participant, or agent in the past 12 months.
However, the reach of this law is very limited. Section 84308 exempts from its
coverage any local government agency where the members are directly elected by the
voters, such as school boards and city councils. Therefore, it does not apply to elected
school board officials, but it can apply if an elected officer also serves as an appointed
member of another, non-exempt agency. For example, an elected school board
member who also sits on another agency’s appointed board, such as a joint powers
authority, may be prohibited from acting on JPA matters that involve campaign
contributors.
