In Part 1 of the four-part series, we will focus on an advanced discussion of the requirements for substantive FAPE under the IDEA. Specifically, we will be considering alternative school settings such as distance learning and emergency closures and how those relate to FAPE and requirements to amend and adjust individual student IEPs. Discussions will look at technology usage in school and how to ensure equal access to distance learning together with confidentiality issues and concerns raised regarding online learning platforms. The discussion will also consider the barriers regarding remote assessment and the effectiveness of completing assessments while limited due to unavailability of in person assessment and observation. Additionally, the presentation will consider parent involvement and FAPE obligations in light of the inability or unwillingness of parents to participate in the student's education. The experienced practitioner will leave this session with tools and tips on how to ensure solid assessments and programming to stave off disagreements and FAPE disputes.
